Abstract

Social media has become the primary space for the public to report and monitor cases of child sexual abuse. While public pressure can accelerate institutional attention, virality can also lead to the dissemination of victim identities, revictimization, contamination of digital evidence, and social punishment before legal proceedings are concluded. This issue has become increasingly complex following the enactment of Government Regulation Number 17 of 2025 concerning Electronic System Governance for Child Protection, Ministry of Communication and Digital Regulation Number 9 of 2026, and Presidential Regulation Number 87 of 2025 concerning the Roadmap for Child Protection in the Online Sphere 2025–2029. This study employs a normative juridical method utilizing statutory, conceptual, policy, and case approaches. The findings indicate that positive law has regulated child protection, victims' rights, personal data protection, platform governance, and development planning, yet it has not provided operational mechanisms linking viral information to victim protection, evidence preservation, law enforcement coordination, and public accountability. This study offers the 72-Hour Public Response Protocol as an initial coordination mechanism, extending beyond the mere time limit for criminal case resolution. The protocol operates through four principles—Preserve, Protect, Process, and Publish—accompanied by time recording, risk classification, designated persons in charge, actions, and outputs for each case. The novelty of this research lies in the integration of digital public pressure into the state's response accountability mechanism without making virality a prerequisite for obtaining justice. Through this model, the public can continue to oversee the state, while the determination of guilt remains within the legal process.
